Bluestocks Terms of Service

1. Introduction and Acceptance
Welcome to Bluestocks (the "App" or "Service"), operated by HODL Media Inc. ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of Bluestocks, including our iOS, Android, and web applications. By accessing or using Bluestocks, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree with these Terms, please discontinue use of the App.

2. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state or federal courts located in Delaware to resolve any legal matter arising from these Terms or your use of Bluestocks.
3. The Bluestocks Service
Nature of the Service
- Bluesky Integration: Bluestocks allows optional integration with the Bluesky social platform so you can view, post, and interact with content from Bluesky within our App. You remain subject to Bluesky's own terms and guidelines.
- Stock & Crypto Tracker: Bluestocks provides market data, charts, and financial information for stocks and cryptocurrencies. Data is sourced from third-party providers such as Finnhub, Ariva.de (Lang & Schwarz), and CryptoCompare. We do not offer investment, financial advice, or brokerage services. The data is provided "as is" and may not be accurate, complete, or timely.
No Financial Advice
All information is for general, informational purposes only and should not be relied upon for investment decisions. We are not registered financial advisors or brokers, and you should conduct your own research or consult a professional before making financial decisions.
Age Restrictions
Bluestocks is not intended for individuals under the age of 13 (or 16, where applicable by law). Refer to our Privacy Policy for details regarding age requirements.
Third-Party Services
Bluestocks may link to or integrate content from external APIs and websites (such as Bluesky, Finnhub, Ariva.de, CryptoCompare). We do not control or endorse third-party services and disclaim all liability arising from their content or actions.
4. User Accounts
Optional Login
You may use Bluestocks without logging in. However, logging in with your existing Bluesky account enables features like cross-device watchlist syncing and combining relevant Bluesky posts with your watchlist.
Account Security
You are responsible for maintaining the confidentiality of your account credentials. If you suspect unauthorized access, please contact us at [email protected].
Termination by You
You can stop using Bluestocks at any time by uninstalling the App or ceasing to access the Service.
Termination by Us
We reserve the right to suspend or terminate your access to Bluestocks if you violate these Terms or engage in conduct that harms our interests, other users, or the integrity of the Service.
5. User Conduct and Content
Acceptable Use
- You agree to comply with all applicable laws and regulations.
- You must not use Bluestocks or any integrated Bluesky features to post unlawful, harassing, hateful, misleading, or otherwise objectionable content.
- You must not scrape, data-mine, or otherwise collect large quantities of data from our servers beyond normal user interactions. Automated bots or scripts are prohibited without prior written permission.
User-Posted Content
When posting or interacting with Bluesky content through Bluestocks, you remain subject to Bluesky's terms and community guidelines.
We are not liable for any user-posted or third-party content you encounter. We reserve the right (but have no obligation) to remove content that violates these Terms or is otherwise objectionable.
Feedback
If you submit feedback or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback for any purpose without additional compensation.
6. Subscriptions and Billing
Subscription Plans
Bluestocks offers premium features via monthly subscriptions, priced at $10–$29 (subject to local variations). Payments are processed through the iOS App Store, Google Play Store, or Stripe on our web version.
Free Trial
We may offer a 30-day free trial for new subscribers. If you do not cancel before the trial ends, you will automatically be charged the applicable subscription fee.
Payment and Refunds
All payments are handled by the respective app store or Stripe. Refund policies vary by platform; any requests for refunds must be made through the relevant provider.

7. Intellectual Property
Ownership
All rights, title, and interest in and to the Bluestocks Service (including trademarks, code, designs, and other materials) are owned by HODL Media Inc. or its licensors.
Limited License
We grant you a non-exclusive, revocable license to use Bluestocks for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works of Bluestocks without our explicit consent.
Third-Party Data
Bluestocks uses APIs and data from third parties (e.g., Finnhub, Ariva.de, CryptoCompare). All third-party content remains the property of its respective owners, and you may be subject to additional terms from those third-party providers.
8. Disclaimer of Warranties
As Is / As Available
Bluestocks is provided "as is" and "as available," without warranties of any kind, express or implied. We disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
No Financial Guarantee
We do not guarantee the accuracy, completeness, or timeliness of market data, nor do we provide financial advice. Use of any information from Bluestocks is at your own risk.
Third-Party Content
We are not responsible for the content, actions, or services of third-party websites or data providers accessed through the App.
9. Limitation of Liability
Exclusion of Certain Damages
To the fullest extent permitted by law, HODL Media Inc. and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from or related to these Terms or your use of Bluestocks.
Liability Cap
In no event shall our aggregate liability exceed the total amount paid by you (if any) to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
Jurisdictional Exceptions
Certain states do not allow the exclusion or limitation of certain damages or implied warranties. In such states, our liability and warranties are limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless HODL Media Inc., its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or any use of the Bluestocks Service not in accordance with these Terms.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of any significant changes via an in-app message or by other reasonable means. Your continued use of Bluestocks after any changes become effective indicates your acceptance of the updated Terms.
12. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HODL Media Inc. regarding Bluestocks.
Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in effect.
Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time.
Export Compliance
You agree to comply with all applicable U.S. and foreign export laws and regulations in using the App.
